IMPORTANT UPDATE:   Please note the NY State Education Department issued  new emergency regulations for special education and a recent memorandum regarding Students With Disabilities "Parentally Placed" in Nonpublic Elementary & Secondary Schools.  The regulations and the memorandum should be carefully reviewed.  The memorandaum is called: "Revised Interim Guidance on Parentally Placed Nonpublic Elementary and Secondary School Students with Disabilities Pursuant to the Individuals with Disabilities Education Act (IDEA) 2004 and New York State (NYS) Education Law Section 3602-c".  The regulations are the emergency part 200 regulations of the commissioner.  You can find both of these by clicking on the website below and clicking on "whats new". http://www.vesid.nysed.gov/specialed/  Contact our office for any specific questions you may have as to how this will impact you. 

The burden of proof for special education matters is now on the school districts.  The district must prove that it provided a free appropriate public education to your child.  This amendment to NY State law was done with the help of parents and parent organizations.
